I am a foreigner citizen and live in Portugal. May I vote in the Portuguese elections?

The vote registration (RE) is mandatory?

The registration in the Vote Registration is volunteer for (article 4):

National citizens of the European Union countries with legal residence in Portugal: Germany, Austria, Belgium, Bulgaria, Cyprus, Denmark, Slovakia, Slovenia, Spain, Estonia, Finland, France, Greece, Holland, Hungary, Italy, Leetonia, Lithuania, Luxemburg, Malta, Poland, United Kingdom, Check Republic, Romania and Sweden;

National citizens of countries with Portuguese as the official language (Cape Verde and Brazil) with legal residence in Portugal over 2 years;

National citizens of other foreigner countries– Norway, Island, Uruguay, Chile and Argentina (Declaration nr. 9/2005, of 8th July, of the Ministry of Internal Administration and Ministry of Foreign Affairs), with legal residence in Portugal over 3 years.

How can I register in the voter registration?

You must go the Voting Commission (CR), at the parish, correspondent to the address indicated in the valid title of residence or at the Foreigner and Boarder Services (SEF).

Where may I register?

The foreigner voters above mentioned may register at the voting commissions or SEF, and will be registered at the address indicated in the valid title of residence or Certificate of Registration or Certificate of Permanent Resident Citizen of the European Union (article 27, nr. 3).

Note: The Brazilian citizens holding the status of equal political rights that voluntarily obtained the citizen card are automatically registered at BDRE, at the voting circumscription related to the address shown in the citizen card, and will be registered at the voting registration targeted to Portuguese citizens (articles 9, nr. 5, 27, nr. 1 and 34, nr. 1).

How is it made the identification and proof of residence?

The national citizens of countries of the European Union, with legal residence in Portugal, are identified with a valid title of identification and prove their legal residence in Portugal through any mean that proves their residence, namely, Certificate of Registration of Citizen of the Union or Certificate of Permanent Residence of Citizen of the Union. (articles 9, nr. 4, 27, nr. 3 e 34, nr. 2);

National citizens of countries with Portuguese as the official language (Cape Verde and Brazil), with legal residence in Portugal, are identified and make proof of residence with a valid title of residence (articles 9 nr. 4, 27, nr. 3 e 34, nr. 2);

National citizens of other foreigner countries, with legal residence in Portugal, National citizens of other foreigner countries: Authorization of Temporary Residence or Authorization of Permanent Residence, according to each case (articles 9, nr. 4, 27, nr. 3 e 34, nr. 2);

How is it done the proof of residence length in Portugal? And how is done the registration of these voters?

Only the holder of an authorization of temporary residence make proof of the residence length (article 12 nr. 2 al. a) e 37 nr. 2 al. a).

The registration of these voters is made via SIGREweb, according to the document of identification that allows to access to the data shown in that same system of identification (civil identification or SEF), being shown in it the data of the voters’ identification (name, parentage, date of birth, natural, nationality...).

This system also allows to complete the identification related to residence and contacts (since that they are obtained with the holder consent).

Must also be filled in, according to each case, the information related to the note “voter for the Republic President”, option of vote in the elections for the European Parliament and information related to the voting registration in the State of origin where the last registration was (article 37).

In the registration act, the CR prints, though SIGRE, the application form for the voter so that he confirms the information and signs (article 38). This application form is then duplicated and one copy is filed, then also signed by the voter, as proof of registration but also proving the options and declaration herein.
